Welcome to Archiv ("we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of our platform, applications, APIs, websites, and services ("Service"). By accessing or using Archiv, you agree to these Terms.

If you do not agree, please stop using the Service immediately.

1. Eligibility

You must be at least 13 years old (or the legal minimum age in your jurisdiction). By using the Service, you confirm you meet this requirement and have the authority to accept these Terms.

2. Description of the Service

Archiv is an AI-powered learning platform that provides:

  • AI Chat: Real-time streaming responses
  • Multimodal Support: Upload and analyze images, videos, text documents, and PDF files
  • AI-Powered File Processing: Analysis of uploaded content
  • Knowledge Graphs: Interactive visual graphs that map topics, concepts, and relationships from your conversations
  • Explore Graphs: AI-generated question-based exploration graphs to help you discover deeper insights
  • Help Graphs: Contextual assistance graphs that provide multiple perspectives on AI responses
  • Quizzes: AI-generated quizzes to test your understanding
  • Mastery Profiling: Adaptive skill analysis and learning progress tracking
  • Conversation History: Storage of messages, files, and learning metadata

Features may change or evolve over time. We reserve the right to modify, suspend, or discontinue any feature at any time.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

  • Keeping your login credentials secure and confidential
  • Ensuring your account information is accurate and up-to-date
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

We may suspend or terminate accounts that violate these Terms, pose security risks, or remain inactive for extended periods.

4. User Content

"User Content" includes messages, files, documents, images, quiz responses, metadata, or any materials you submit, upload, or generate through the Service.

By using Archiv:

  • You retain full ownership of your User Content
  • You grant Archiv a worldwide, non-exclusive, royalty-free license to process, store, analyze, and use your User Content solely to operate, improve, and provide the Service
  • You represent and warrant that your User Content does not violate any laws, infringe on third-party rights, or contain harmful material
  • You are solely responsible for the legality and appropriateness of your User Content

We do not claim ownership of your intellectual property. Your files and data remain yours.

5. Privacy

Your privacy is important to us. Please review our Privacy Policy for detailed information about how we collect, use, protect, and share your personal information.

6. AI-Generated Output

Archiv uses artificial intelligence to generate responses, quizzes, and analyses. By using the Service, you acknowledge and agree that:

  • AI output may be incomplete, inaccurate, outdated, or unpredictable
  • AI responses are for informational and educational purposes only
  • You are solely responsible for verifying and validating any important information
  • AI output should not be relied upon for medical, legal, financial, or professional advice
  • Archiv is not liable for any decisions, actions, or outcomes based on AI-generated content

AI output is provided "as is" without warranties of any kind.

7. Acceptable Use

You agree to use Archiv responsibly and lawfully. You agree not to:

  • Upload harmful, illegal, defamatory, obscene, or infringing content
  • Use the Service to generate content that promotes violence, hate speech, or discrimination
  • Attempt to reverse-engineer, decompile, or disrupt the Service
  • Use automated tools, bots, or scripts to access the Service without authorization
  • Circumvent usage limits, security measures, or access controls
  • Use Archiv for harassment, stalking, misinformation, or fraud
  • Impersonate others or misrepresent your identity
  • Violate any applicable laws or regulations

Violation of these rules may result in immediate suspension or termination of your account.

8. Intellectual Property

The Archiv name, logo, trademarks, branding, user interface, algorithms, source code, and platform designs are owned by Archiv and protected by intellectual property laws.

You agree not to copy, modify, distribute, sell, license, or create derivative works from our intellectual property without prior written permission.

9. Subscription Plans and Pricing

Archiv offers both free and paid subscription plans:

9.1 Free Plan

  • Up to 3 conversations
  • Up to 1 MB file size per conversation
  • Access to AI-powered chat
  • Basic features and community support

9.2 Premium Plan ($20/month)

  • Unlimited conversations
  • Up to 100 MB file size per conversation
  • Ability to delete conversations
  • All AI features
  • Priority support via email and WhatsApp
  • All current and future premium features

9.3 Billing

  • Prices are displayed in USD before purchase
  • Subscription charges occur at the start of each billing cycle
  • By subscribing, you authorize our payment processor to charge your selected payment method
  • Subscriptions automatically renew unless canceled before the renewal date

Failure to pay may result in service limitation, downgrade to free plan, or account suspension.

10. Payment Processing

Payments are processed by Gumroad, a third-party Merchant of Record (MoR). By making a purchase:

  • You agree to Gumroad' terms of service and privacy policy
  • Gumroad handles payment processing, tax compliance, and billing on our behalf
  • We accept major credit cards, debit cards, and other payment methods supported by Gumroad
  • All transactions are secured using industry-standard encryption

We do not store your full payment card details. All sensitive payment information is handled directly by Gumroad.

11. Refund Policy

11.1 General Policy

Due to the nature of digital services, we generally do not provide refunds for:

  • Partially used subscription periods
  • Unused features or credits
  • Dissatisfaction with AI output quality or variation
  • Change of mind or accidental purchases (after service has been accessed)
  • Features that were misunderstood by the user

11.2 Refund Eligibility

A refund may be considered in the following circumstances:

  • You were charged incorrectly or duplicated
  • You experienced a verified, significant service outage affecting your use
  • Technical issues prevented you from accessing paid features
  • You request a refund within 24 hours of purchase and have not substantially used the service
  • Refunds are legally required in your jurisdiction

11.3 How to Request a Refund

To request a refund, contact us at [email protected] with your purchase details and reason for the request. We will review your case within 5-7 business days.

11.4 Refund Processing

If approved:

  • Refunds are credited to the original payment method
  • Processing time is typically 5-10 business days, depending on your payment provider
  • Refund amounts may be subject to currency conversion or bank fees

11.5 Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You will retain access to premium features until the end of your current billing period
  • Your account will be downgraded to the free plan after the billing period ends
  • No prorated refunds will be issued for unused time

12. Third-Party Services

Archiv integrates with third-party services to provide functionality:

  • Supabase: Authentication, database, and storage
  • Google Gemini: AI language models for gathering conversation knowledge graphs
  • OpenRouter: AI API gateway for knowledge graph generation and chat responses
  • Gumroad: Payment processing and billing
  • Analytics providers: Usage analytics and performance monitoring

These services are governed by their own terms and privacy policies. We are not responsible for third-party service failures, data handling, or policy changes.

13. Service Availability

We strive for high uptime and reliability but do not guarantee uninterrupted access. Archiv is not responsible for:

  • Scheduled or unscheduled maintenance downtime
  • Service interruptions due to third-party providers
  • Lost data due to technical failures (we recommend maintaining backups)
  • Force majeure events (natural disasters, wars, government actions, etc.)
  • Internet connectivity issues on your end

Users should maintain independent backups of important data and content.

14. Termination

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent, abusive, or illegal activity
  • Pose security, legal, or reputational risks
  • Request account deletion
  • Fail to pay for subscribed services

Upon termination:

  • Your access to the Service ends immediately (or at the end of billing period for voluntary cancellation)
  • We may delete your data after a reasonable retention period
  • Some data may be retained for legal, security, accounting, or backup purposes

You may close your account at any time through your account settings or by contacting support.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Archiv is not liable for any indirect, incidental, special, consequential, or punitive damages
  • Archiv is not liable for loss of profits, data, goodwill, or other intangible losses
  • Archiv's total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim

You acknowledge and agree that you use the Service at your own risk.

16. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. We specifically disclaim:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Guarantees of accuracy, reliability, or completeness of AI output
  • Guarantees of uninterrupted, secure, or error-free operation
  • Warranties that the Service will meet your specific requirements

17. Indemnification

You agree to indemnify, defend, and hold harmless Archiv, its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

18. Changes to These Terms

We may modify these Terms at any time. When we make significant changes:

  • We will update the "Last updated" date at the top
  • We will notify users via email or in-app notification
  • Continued use of the Service after changes constitutes acceptance of the new Terms

If you do not agree to the updated Terms, you must stop using the Service.

19. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Indonesia. Any disputes arising from these Terms or your use of the Service will be resolved in the courts of Indonesia, except where otherwise required by applicable law.

For users in the European Union, you may also have rights under EU consumer protection laws that cannot be waived.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Archiv regarding your use of the Service.
